Mediation
Followed, in the Absence of a Settlement, by Arbitration
This process combines, sequentially, both mediation and
arbitration. Where the parties agree to submit to the procedure,
they must first endeavor to resolve the dispute through mediation.
If a settlement is not reached through mediation within a period
of time designated by the parties, the parties agree to appoint
the Mediator to act as an Arbitrator for a binding decision. The
dispute may also be referred by the parties to a different neutral
to act as an Arbitrator.
